ABOUT THE PROOF OF SERVICE

The proof of service is required on most documents throughout the case from any party sending anything to the other side. This is essentially a declaration from a disinterested person saying that they carried out the service of the described documents, including the method of service and date and location of origin. The person serving can live in your home, but must be over the age of 18 and not a party named in the lawsuit. Carefully follow the prompts listed in the instruction version.

YOUR ACTION STEPS— PROOF OF SERVICE- POS-030

  1. Check that you have provided the correct information for your name, address, phone number, case number. 

  2. Check that the information in the entire form is correct. Most people fail to fill in: section 2 is filled out with the address information for the person who will serve the documents; and section 3 is filled in with the date that the document is served, and the city and state from where it is served, and the description of the document. 

  3. Someone (over the age of 18 and not a party to the lawsuit) will need to serve the documents on your behalf by mail. Please follow the instructions on page 2 of the POS -030. Be sure that all parts are filled out correctly, if this is not done correctly, you may impede your case.   

  4. You will need to make 2 copies of the first page only (don’t make copies of the instructions, you can toss the instructions-- You’ll end up with 1 original, and 2 copies, 3 docs total)
